Description

The United States District Court for the Northern District of Georgia, Rome Division granted partial summary judgment in favor of an insurance carrier in a declaratory judgment action. The insured failed to satisfy a condition precedent to coverage under the policy when he failed to timely provide notice of a motor vehicle accident to the insurance carrier. The court held that coverage available to the third parties for claims arising out of the accident, if any, was limited to the statutory minimum bodily injury liability limits.
