Procedural Pitfalls and Winning Appeals: Strategies for Success in the Appellate Courts
John Bunyan presented “Procedural Pitfalls and Winning Appeals: Strategies for Success in the Appellate Courts” at the Atlanta Bar Association’s Sole Practitioner and Small Firm section’s monthly breakfast meeting on January 16, 2014. The appeals process can be daunting for trial lawyers who do not practice often in the appellate courts due to the strict filing requirements and deadlines and the different structure of appellate briefs. This presentation focused on the necessary questions practitioners need to answer at the onset of an appeal in order to perfect an appeal and prevent dismissal on procedural grounds. This presentation also provided practice tips on drafting the sections of an appellate brief, such as enumerations of error and standards of review, and highlights appellate procedural arguments that lawyers should use to their advantage.
