Defense Award in Potential Catastrophic Workers’ Compensation Case

Lynn Olmert defended a case for a major insurance client where the claimant sought income benefits and medical benefits in connection with an injury allegedly occurring when he was trying to stop his car from rolling. His injuries were significant, and there was significant exposure with a distinct possibility that he could have reached catastrophic levels. She was able to prove that the details of the accident were inconsistent and that the claim was denied based on the idiopathic defense. After a lengthy hearing before the judge, on September 28, 2012, the court ruled in favor of the employer/insurer. The case was appealed by the Appellate Division, and the employer/insurer prevailed. No further appeal was filed and the case was closed.
