Motion for Summary Judgment Granted on a Third-Party Beneficiary Breach of Contract Claim

February 18, 2011

Brent Meyer filed a Motion for Summary Judgment on claims brought by a developer alleging it was a third-party beneficiary of a contract agreement between an architect and civil engineering/surveying firm. The court granted the motion for summary judgment after Brent successfully argued that the developer was not an intended beneficiary of the contract at issue and the developer presented no evidence of harm by the alleged breach by the civil engineering and surveying firm.
