Motion for Summary Judgment Granted on Negligent Misrepresentation Claim against Design Professional

February 18, 2009

Brent Meyer had their motion for summary judgment granted in the Superior Court of Fayette County, Georgia. The plaintiff asserted a negligent misrepresentation claim against a design professional based upon representations made within the plans. Brent filed a motion for summary judgment arguing that the claims were barred by the applicable statute of limitations. In response, the plaintiff argued that it incurred damage to personal property and was entitled to a different claim accrual date. The Superior Court Judge ruled in favor of the design professional client and dismissed all claims asserted as a matter of law.
