Motion for Summary Judgment Prompts Voluntary Dismissal of Nursing Home General Liability Case

June 6, 2012

Dan McGrew and Neil Edwards obtained a voluntary dismissal of a general liability case against a nursing home as a result of their motion for summary judgment. Plaintiff contended that she fractured her hip due to unsafe conditions on the premises and was seeking $250,000 in damages including medical expenses for a hip replacement surgery. After limited discovery, Dan and Neil filed a motion for summary judgment on behalf of the nursing home. Rather than respond to the motion, Plaintiff’s counsel acknowledged the merits of the motion, voluntarily dismissed the action, and did not re-file.
