Nursing Home Physician Dismissed

Spencer Bomar handled a case alleging wrongful death and involving geriatric patient with dementia who fell from wheelchair multiple times experiencing head trauma. It was alleged that physician improperly discontinued restraining devices used to prevent falls. Expert evidence revealed proper restraint reduction program in place and that more falls occurred with restraining devices employed than without over course of patient’s admission. After conducting extensive discovery, including expert discovery, plaintiff’s counsel withdrew from the case, and plaintiff pro se ultimately dismissed the case voluntarily.
