Plaintiff Dismisses Lawsuit Against Accounting Firm in the Face of Motion to Dismiss

Billy Newcomb and Joe Kingma represented an accounting firm accused of professional negligence and breach of fiduciary duty for allegedly 1) failing to inform its client that an employee had been embezzling funds from the company and 2) failing to properly monitor and maintain the client’s financial records. The client-plaintiff alleged damages in excess of $2 million.

Billy and Joe filed a pre-discovery motion to dismiss. Rather than opposing the motion, the plaintiff dismissed the lawsuit.
