Representation and Defense of Various Clients in Insurance Coverage & Bad Faith Litigation
Ryan Wilhelm has represented and provided defense for a variety of clients in insurance coverage & bad faith litigation.
Represented various insurance companies by issuing coverage opinions on a wide range of coverage issues. Examples of these coverage opinions include: whether the insurer was required to pay for the total loss of a luxury sedan after the insured inadvertently failed to make monthly premium payments; whether the insurer was required to provide indemnity and/or defense to its insured who was involved in an automobile accident involving an intentional act; and whether the insurance company was required to defend its insured pursuant to an indemnity/hold harmless agreement. Defended an insurance company in a declaratory judgment action seeking a determination of whether property damage caused to a residential home was covered by the general contractor’s builder’s risk policy. Represented an architectural firm in a declaratory judgment action filed by the insurance company that issued a commercial general policy to a co-defendant contractor. The insurance company contended that coverage was not available because of the “your work” exclusion contained in the policy. The architectural firm and others successfully established at summary judgment that coverage was available under the policy. Represented a dentist in a declaratory judgment action filed by an insurance company seeking to disclaim coverage for claims relating to the alleged breach of a partnership agreement.
