Summary Judgment Affirmed for the Defense in Premises Liability Case

In a premises liability action, the Court of Appeals recently affirmed a grant of summary judgment to Dan McGrew‘s amusement park client. The case arose out of a slip and fall incident that occurred on a rainy day on steps leading to a water ride at the amusement park. The plaintiff, a patron of the park, was descending the steps when she slipped and sustained a serious injury to her wrist. She alleged that the design of the steps was unsafe and that the park should have warned patrons that the steps could become slippery when wet. The trial court found that the plaintiff had equal or superior knowledge of the condition of the steps and granted summary judgment to the park. The Court of Appeals Affirmed.
