Motion to Dismiss Granted in D&O Case in Federal Court
Doug MacKelcan and Will Farley obtained a dismissal with prejudice of an employment lawsuit filed in federal court. Doug and Will represented a former member of the Board of Directors of the corporate defendant in a lawsuit filed by a former executive. The lawsuit contained causes of action for wrongful retention of wages, breach of contract, conversion, violation of ERISA, slander, and wrongful termination. Doug and Will immediately filed a Motion to Dismiss all claims, which was granted by the Court.
